Upon approval, Affiliates can earn a commission up to 80% after any fees, coupons or deductions have been applied.

Then, once a month, Creative Attribute pays you any commission you have earned when your account balance reaches $10 Canadian Dollars.

By participating in our affiliate program, you agree with Creative Attribute’s Terms and Conditions.

Creative Attribute does not condone any illegal, hate, and so forth on your site, or on sites that you affiliate with.

Decisions made by Creative Attribute about affiliate applications are final, but you are free to re-apply if you wish in the future, should your application not be accepted. Please provide as much detail as possible when applying so that we can review your application accurately.

TERMS AND CONDITIONS

Our affiliates are very important to us and we take extreme pride and care to treat you with the upmost respect. We have written the following affiliate agreement with you in mind, as well as to protect our company’s good name.

BY SUBMITTING THE ONLINE APPLICATION YOU ARE AGREEING THAT YOU HAVE READ AND UNDERSTAND THE TERMS AND CONDITIONS OF THIS AGREEMENT AND THAT YOU AGREE TO BE LEGALLY RESPONSIBLE FOR EACH AND EVERY TERM AND CONDITION.

1. Overview

This Agreement contains the complete terms and conditions that apply to you becoming an affiliate in Creative Attribute’s Affiliate Program. The purpose of this Agreement is to allow our affiliates to promote their coupon code on their web site or social media account and the Creative Attribute web site. Please note that throughout this Agreement, “we,” “us,” and “our” refer to Creative Attribute, and “affiliate,” “you,” “your,” “their” and “yours” refer to the Affiliate.

2. Affiliate Obligations

2.1. To begin the enrollment process, you will review this agreement, ask questions, and complete and submit your signature after. The fact that we approve applications does not imply that we may not re-evaluate your application at a later time. We may reject your application at our sole discretion. We may cancel your application if we determine that you are unsuitable for our Program, including if it:

2.1.1. Promotes illegal activities.

2.1.2. Incorporates any materials which infringe or assist others to infringe on any copyright, trademark or other intellectual property rights or to violate the law.

2.1.3. Includes “Creative Attribute” or variations or misspellings thereof in its domain name.

2.1.4. Is otherwise in any way unlawful, harmful, threatening, defamatory, obscene, harassing, or racially, ethnically or otherwise objectionable to us in our sole discretion. This includes any and all forms of discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.

2.1.5. Contains software downloads that potentially enable diversions of commission from other affiliates in our program. This includes software downloads that may corrupt, modify, or disable the tracking functionality provided to you related to the program that may misrepresent your assets.

2.1.6. Imitation may be the sincerest form of flattery, but you may not create or design your website or any other website that you operate, explicitly or implied in a manner which resembles our website nor design your website in a manner which leads customers to believe you are Creative Attribute or any other affiliated business.

2.2. It is entirely your responsibility to follow all applicable intellectual property and other laws that pertain to your site. You must have express permission to use any person’s copyrighted material, whether it be a writing, an image, or any other copyrightable work. We will not be responsible (and you will be solely responsible) if you use another person’s copyrighted material or other intellectual property in violation of the law or any third party rights.

3. Creative Attribute Rights and Obligations

3.1. We have the right to monitor your site at any time to determine if you are following the terms and conditions of this Agreement. We may notify you of any changes to your site that we feel should be made, or to make sure that your links to our web site are appropriate and to notify you of any changes that we feel should be made. If you do not make the changes to your site that we feel are necessary, we reserve the right to terminate your participation in the Creative Attribute Affiliate Program.

3.2. Creative Attribute reserves the right to terminate this Agreement and your participation in the Creative Attribute Affiliate Program immediately and without notice to you should you commit fraud in your use of the Creative Attribute Affiliate Program or should you abuse this program in any way. If such fraud or abuse is detected, Creative Attribute shall not be liable to you for any commissions for such fraudulent sales.

3.3. Creative Attribute reserves the right to terminate this Agreement and your participation in the Creative Attribute Affiliate Program should your sales or coupon performance not reach our $10 Canadian Dollars threshold for consecutive months.

4. Modification

We may modify any of the terms and conditions in this Agreement at any time at our sole discretion. Modifications may include, but are not limited to, changes in the payment procedures and Creative Attribute’s Affiliate Program rules. If any modification is unacceptable to you, your only option is to end this Agreement. Your continued participation in Creative Attribute’s Affiliate Program following the posting of the change notice or new Agreement on our site will indicate your agreement to the changes.

5. Tracking & Payment

5.1. Creative Attribute uses a third party to handle all of the tracking and payment. The third party is PayPal, WooCommerce, and Google Analytics. Kindly review the network’s payment terms and conditions.

5.2. All payments will be made through PayPal. Creative Attribute will not cover your PayPal fees.

5.3. You will create an account on Creative Attribute so that you may receive your reports that will describe our calculation of the commissions due to you.

5.4. All payments will be made in Canadian Dollars (CAD).

5.5. Any sales made must be fulfilled before commission payment is made. This includes but is not limited to pre-order items, out of stock items and items waiting to be reprinted. Creative Attribute reserves the right to withhold commission payments for these sales until the order is fulfilled.

5.6. Any sale that is returned for whatever reason will be subject to a commission refund to be paid as a deduction of the next commission payment.

6. Promotion Restrictions

6.1. You are free to promote your own web sites, but naturally any promotion that mentions Creative Attribute could be perceived by the public or the press as a joint effort. At all times, you must clearly represent yourself and your web sites as independent from Creative Attribute. You should know that certain forms of advertising are always prohibited by Creative Attribute, including but not limited to:

6.1.1 Spam. Under no circumstances shall You send commercial electronic mail messages as defined in the new Federal spam law, the CAN-SPAM Act of 2003 [the “Act”], with respect to Creative Attribute’s Affiliate Program. You may use mailings to customers to promote Creative Attribute so long as the recipient is already a customer or subscriber of your services or web site, and recipients have the option to remove themselves from future mailings. If it comes to our attention that you are spamming, we will consider that cause for immediate termination of this Agreement and your participation in the Creative Attribute Affiliate Program.

6.1.2. Unsolicited commercial email (UCE), postings to non-commercial newsgroups and cross-posting to multiple newsgroups at once. You may post to newsgroups to promote Creative Attribute ONLY if the news group specifically welcomes commercial messages.

6.1.3. You may not advertise in any way that effectively conceals or misrepresents your identity, your domain name, your social media account, or your return email address.

6.2. Affiliates that among other keywords or exclusively bid in their Pay-Per-Click campaigns on keywords such as Creative Attribute.com, Creative Attribute, www.Creative Attribute, www.Creative Attribute.com, and/or any misspellings or similar alterations of these. Be it separately or in combination with other keywords – and do not direct the traffic from such campaigns to their own website prior to re-directing it to ours, will be considered trademark violators, and will be banned from Merchant’s Affiliate Program. We will do everything possible to contact the affiliate prior to the ban. However, we reserve the right to expel any trademark violator from our affiliate program without prior notice and on the first occurrence of such PPC bidding behaviour.

6.3. Affiliate shall not transmit any so-called “interstitials,” “Parasiteware™,” “Parasitic Marketing,” “Shopping Assistance Application,” “Toolbar Installations and/or Add-ons,”

6.4. Any pending balances owed to you will not be paid if your account is terminated due to such unacceptable advertising or solicitation.

7. Affiliate Payment

7.1. You will receive a Commission for sending authorized sales, leads, and/or clicks to Creative Attribute via Coupon codes, products and services. In order to place your coupon codes, you must first be approved by Creative Attribute to become an affiliate of our program. You understand that the payout amount may be changed at any time. You are responsible for determining if the payout for a link you have placed on your site has changed or been discontinued. You receive the commission from Creative Attribute. Payments are made automatically on the twenty-seventh (27th) day of each month when your account balance reaches $10 Canadian Dollars or more for the previous months’ transactions. Money credited to your account does not accrue interest. In the event of a VOID, Creative Attribute or PayPal may recover from you the corresponding commission previously credited to your account. The VOID commission will be immediately deducted from your account balance. In the event that your account balance is less than the VOID commission, the VOID commission will be deducted against your future earnings. You will NEVER be asked to send money to Creative Attribute.

7.2. Affiliate will receive the posted dollar amount of commission or the posted percentage of the total purchase price for every sale they refer that is directly referred by the affiliate to our site through the affiliate’s unique coupon code or cookie. This ONLY includes sales that are driven from the Affiliate to our site and as tracked through the Affiliate’s unique coupon code provided by us or the cookie resulting from that coupon code. You can earn a commission up to 80% after any fees, coupons or deductions have been applied.

7.3. Commissions are not paid on, and will not include, a single sale to the Affiliate themselves, meaning Affiliate cannot purchase the product for their own use through their link and receive a commission on that sale. Such commissions will be voided and the Affiliate may be removed from the program.

7.4. Upon approval, Affiliates can earn a commission up to 80% after any fees, coupons or deductions have been applied.

7.5. There could be a delay in processing payments due to volume. Payments could be delayed up to 90 days.

8. Grant of Licenses

8.1. We grant to you a non-exclusive, non-transferable, revocable right to (i) access our site through HTML links solely in accordance with the terms of this Agreement and (ii) solely in connection with such links, to use our logos, trade names, trademarks, and similar identifying material (collectively, the “Licensed Materials”) that we provide to you or authorize for such purpose. You are only entitled to use the Licensed Materials to the extent that you are a member in good standing of Creative Attribute’s Affiliate Program.

8.2. Each party agrees not to use the other’s proprietary materials in any manner that is disparaging, misleading, obscene, or that otherwise portrays the party in a negative light.

9. Disclaimer

CREATIVE ATTRIBUTE MAKES NO EXPRESS OR IMPLIED REPRESENTATIONS OR WARRANTIES REGARDING CREATIVE ATTRIBUTE SERVICE AND WEB SITE OR THE PRODUCTS OR SERVICES PROVIDED THEREIN, ANY IMPLIED WARRANTIES OF CREATIVE ATTRIBUTE ABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT ARE EXPRESSLY DISCLAIMED AND EXCLUDED. IN ADDITION, WE MAKE NO REPRESENTATION THAT THE OPERATION OF OUR SITE WILL BE UNINTERRUPTED OR ERROR FREE, AND WE WILL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS.

10. Miscellaneous

You agree that you are an independent contractor, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between you and Creative Attribute.
